<p>What is a Telematics System?</p>

But the Ninth Circuit doesn’t make precedent for the whole country, and the U.S. Court of Appeals for the District of Columbia recently ruled that extended tracking via GPS requires a warrant. But, since conflicting precedent has now been set on the West Coast, this issue is bound for the Supreme Court.

In the case, DEA agents secretly planted a <a href="http://www.fieldtechnologies.com">GPS vehicle tracking</a> system on Juan Pineda-Moreno’s Jeep at night while it was parked outside his home, and then used it to pinpoint the illegal marijuana crop he was cultivating. Pineda-Moreno appealed the case on the grounds that the secret GPS tracking violated his Fourth Amendment rights, but a three-judge panel denied his appeal in January and a larger panel ruled this month against reconsidering the case.]]></description>

<p>This decision upsets years of legal precedent establishing “curtilage” (legalese for the property surrounding a house) as protected under the Fourth Amendment, and represents an officiously narrow interpretation of the “open fields doctrine” test established in United States v. Dunn in 1987. In that case, DEA agents tracked a large shipment of chemicals used to manufacture drugs to Mr. Dunn, a meth lab operator. Agents crossed his fence, looked through the barn window, found the meth lab, executed a search warrant and convicted Dunn of conspiracy to manufacture and distribute methamphetamine.</p>
<p>The prosecution argued that, as per Hester v. United States, Fourth Amendment protection does not extend to the “open fields.” Dunn argued that the case didn’t concern an “open field”; it concerned a barn surrounded by barbed wire. Dunn’s conviction was thrown out by the Supreme Court, and established the four-point test of whether curtilage privacy protections apply.</p>
<p>From the ruling, “curtilage questions should be resolved with particular reference to four factors: the proximity of the area claimed to be curtilage to the home, whether the area is included within an enclosure surrounding the home, the nature of the uses to which the area is put, and the steps taken by the resident to protect the area from observation by people passing by.”</p>
<p>In the majority opinion, the Ninth Circuit Court ruled that since Pineda-Moreno’s driveway wasn’t enclosed and was open to passersby like delivery men and neighborhood children, it didn’t pass the Dunn test for curtilage.  Never mind that in the Dunn opinion, the majority writes “we do not suggest that combining these factors produces a finely tuned formula that, when mechanically applied, yields a “correct” answer to all extent-of-curtilage questions.”<br />

School district transportation managers are responsible for thousands of children each day once they step onto the school bus. Most state laws are very strict when it comes to school buses to ensure the safest operational and driving procedures possible.<br />

<p>The Omaha Public School (OPS) District tested a GPS fleet management system on five buses for six weeks in Spring 2010. Transportation manager David Wolfe was impressed with the GPS system and how helpful the information was. The district&#8217;s transportation officials are now installing GPS tracking devices on the 264 small buses the district owns and operates. “This is a significant accountability piece,” David Wolfe recently told the school board. He said it would be a good addition for buses that carry students to athletic events or other activities, which often involve travel to less familiar sites outside the district. With fleet GPS systems, transportation managers can answer daily inquiries about vehicle operations: “Where was the bus last Tuesday at 2 p.m.?” and “How fast was the bus going yesterday afternoon on State St.?”</p>
<p>OPS will use the information from the GPS system to monitor a variety of things. It will track how far late buses are from their destinations and pinpoint the location if a bus breaks down. The GPS tracking system will record idle time so routes can be adjusted, reducing time on the road and miles traveled.  In addition, the GPS tracking system will record when and how often doors open and how long a bus&#8217;s stop arm is used. All of this information will help the school district run efficient routes, saving on fuel and other operating expenses. It will keep drivers accountable to drive both safely and efficiently. It will keep parents informed on where their children are and when they will arrive home. Most importantly, it will keep children safer because their location will be immediately known if a problem ever arises.</p>
<p>School bus managers have many of the same problems as commercial fleet managers. It can be difficult to gather precise information about what route was driven, how long stops took, track where a vehicle is located in real-time and to keep up with vehicle maintenance. With the help of GPS fleet tracking devices, schools and bus companies can now monitor buses from a computer or cell phone ensuring child safety which keeps parents happy and also reduces overhead by being more efficient.  GPS enables a transportation manager to improve fleet operations by comparing actual driving paths, stop locations and stop times against planned routes, stops and times. The GPS system will uncover hidden costs that contribute to wasteful spending, such as inefficient bus routes, excessive engine idling, courtesy stops, and underutilized buses.</p>
<p>Fleet tracking systems work like any other GPS tracking system. Each vehicle in the fleet is equipped with a device that communicates with satellites to determine the location and movement of the vehicle. This information can be monitored constantly or checked at regular intervals, depending on the device and software used. It can be real-time or recorded and used for future study. The information collected can be used to keep drivers accountable, calculate costs, and plan more efficient movement of people and goods.</p>

<p>Field Technologies, a provider of GPS asset management solutions, has been committed to answering that question for its customers since its inception. A Field Technologies representative states that “our systems have been able to help companies save up to hundreds of thousands of dollars a year in reduced labor costs. We show our potential customers the benefits they will receive from implementing GPS tracking into their current operations; and one of the easiest ways to do that is by having them hear about those benefits from the customers themselves.”</p>
<p>GPS tracking systems provided by Field Technologies have become one of the most popular new technologies among businesses in a variety of industries. We now have instances where we call the driver and say &#8216;You&#8217;re on the Expressway doing 65 mph. Slow down.&#8217; We&#8217;ve found it amazing.&#8221; Ed Radford, an operations manager for Hayward Baker Inc. in Fort Worth , TX states that “We don&#8217;t have a supervisor on every job,” he says, “but we&#8217;ve discovered that the employees&#8217; knowledge that the machine hours are being tracked has resulted in a reduction in the number of hours being reported on payroll.” He went on to claim that he has seen at least a 6% drop in payroll since instituting GPS tracking technology. These savings are not limited to those two companies as Monte Yoder, CFO of Hoffman Southwest, will claim, “Hoffman has realized over a 150% return on investment in the form of reduced labor costs, increased revenue, and improved vehicle maintenance.” “Drivers really like the system because it helps them to spend less time getting to jobs and more time actually doing jobs!” said Yoder. He went on to explain that they have estimated an increase in profits of $200,000 from additional service calls, improved routing capabilities and overall efficiency of their workforce by utilizing the GPS tracking system. They are also able to utilize GPS for accurately tracking hours worked at each job to ensure that they matched the hours reported on employee timesheets, reducing overtime costs significantly.</p>

<p>In August of 2005 law enforcement agencies in Ventura County stopped a 9-state equipment theft crime ring. The operation required &ldquo;9,000 hours of investigation&rdquo; and &ldquo;netted 2 arrests, nearly 26,000 pieces of equipment valued at $3.5 million, and helped 215 victims from 64 cities in nine states identified so far&rdquo;. Authorities believe there are many more victims, including large and small construction firms, landscaping, and equipment rental companies.&rdquo;</p>

<p>Thanks to Field Technologies &#8216; GPS tracking systems, its customers no longer have to worry about such theft issues. Until now, the most popular theft recovery devices required you to wait 48 hours after the theft to file a police report before they would attempt to recover your stolen machine or vehicle. Aside from the theft of the vehicle , I&#8217;d say within a year and a half the system had paid for itself.&quot; Field Technologies &#8216; customer Theresa, from Blacks Towing in Temecula, CA explained how, &ldquo;It helped us get our truck back. On July 4th, someone punched our driver out and jumped in the truck and      took off. He crashed it into a power pole and we were on the GPS watching him and told the police where to get him.&rdquo; </p>
<p>The ability to locate and reclaim a stolen piece of asset is a priceless commodity.
